Adoptions

When a child is adopted, the parent-child relationship legally exists between the adopted children and the adoptive parents as if the child were born to the adoptive parents during the marriage.  Any adult is basically eligible for adoption of a child, whether they are single or married, or whether they are a resident or nonresident, as long as the court finds that it is in the child’s best interest.  If the petitioner who is seeking adoption of a child is married, then both spouses must join in the petition for adoption.  In taking the child’s best interests into consideration, the court may not deny or delay a petition for adoption on the basis of race or ethnicity of either the child or the prospective parents.

In Texas, a child may be adopted in a number of situations, such as, if the biological parents of the child have died; or the parent-child relationship of either of the living parents has been terminated; or if a step parent wants to adopt the child.  Typically, the child must have lived with the petitioner of an adoption for at least six months, unless the court waives this requirement, based on what is in the best interests of the child.
