When a husband and wife consider filing for divorce, there are often issues regarding their property. The division of property in a divorce is somewhat dependent on state laws.

Because Texas is a community property state, the estate must be divided according to certain rules and regulations. Community property includes any assets or income that were acquired or accumulated during the marriage, while separate property includes assets and income from before the marriage.
