In any lawsuit, it is important to remember that each party has responsibilities. The party who sued you, the credit card company, must prove their case by a standard call a “preponderance of the evidence.” This basically means that it has to be more likely than not that their facts are true. This is a much lower standard than the criminal standard of “beyond a reasonable doubt.”

In proving their case, the creditor must produce documents (copies of agreements and/or bills sent to you over the life of the entire account). Another way the creditor can prove their case is by having somebody testify as a witness at trial.
