HOW MUCH TIME DO I HAVE TO RESPOND TO THE LAWSUIT?

When you are sued with a credit card lawsuit in Texas, you are given copies of the Original Petition and of the Citation. Generally on the Citation or the first page of the lawsuit, there is an explanation of the time period you have in which to respond or file an answer to the lawsuit. If the lawsuit was filed against you in a Justice Court, typically where most of these cases are filed, you have to file an answer on or before 10:00 am on the Monday following the expiration of 10 days.

In County or in District Court cases, you have to file an answer on the Monday next following the expiration of 20 days. As you can see, it can be difficult to establish exactly when your answer is due. In addition to the above referenced guidelines, sometimes holidays and methods of answering can change the dates your answer is due.
