Discovery

Smith & Garg - North Houston Attorneys

Conroe Discovery Often Discovery is the most expensive part of the divorce process if it is necessary.  So, what is Discovery?  Discovery is simply a way in which each party in the divorce can ask each other questions and receive answers about the cause of the divorce, assets, or other issues related to the divorce.  Discovery can take several forms and can be accomplished in many different ways which are all governed by the Texas Rules of Civil Procedure:  Request for Disclosure, Interrogatories, Requests for Production, and by Deposition.  Request for Disclosure are standard questions which each side is required to answer.  In family law cases, Disclosure often times refers to an accounting of assets and debts which both parties are required to furnish.  Interrogatories refer to written questions each party can send to the other party.  There is a limit of 25 Interrogatories which can be sent by each party.  Requests for Production refer to requests for tangible documents or electronic data which a party must produce to the other party when requested.  There is no limit on the number of Requests for Production which can be sent to the other party.

The final tool a party can use to discover information about the other party is called a deposition  A deposition is a procedure whereby an attorney for a party, with a court reporter present, gets an opportunity to question the opposing party on any matter relevant to the divorce.  This process can be extremely messy, emotional and expensive and is usually reserved as a last resort and only in contested divorce cases.    If you are in the process of getting a divorce or have already been served with divorce papers, you need the help of a competent and aggressive Conroe Divorce Attorney or a Spring Divorce Attorney.
