In Texas, the Courts are able to make a just and right distribution of the marital assets.  Does this sound a little broad and cryptic?  Well, it is!  What this means is that at the end of a case, after the court has had an opportunity to examine all the evidence and see all the testimony, it can do what it thinks is fair.  Generally, however, the Courts will split the property pretty evenly absent cause.  If, on the other hand, one party to the divorce has committed adultery and has been abusive, then it is very likely that the Court will award a disproportionate share of the assets the other spouse.  Other issues which could affect the disbursement of property are the circumstances surrounding the marriage, like is if one party was handicapped or had no real job training and was unable to support them self.    More on property division here.
