What is a fault-based divorce?
This is a divorce where one party (usually the one filing for divorce) alleges that the marriage has failed due to the fault of the other. The grounds for a “fault-based” divorce in the state of Texas are abandonment, adultery, imprisonment lasting more than one year, felony conviction, institutionalization due to insanity for at least three years, and cruel or inhuman treatment.
