What is a Marriage annulment?
A marriage annulment may be granted when it can be proved that there was something wrong with the initial marriage ceremony. If you ask the court for an annulment, you are asking the court to void the marriage as if it never took place. Some grounds for being granted an annulment include: not being of sound mind at the time of the ceremony (i.e. intoxication); one of the parties to the marriage was not of legal age and the ceremony took place without the consent of a legal parent or guardian; one of the parties lacks the mental capacity to understand the marriage contract; and fraud in the inducement of the marriage, where one party lied to the other regarding some personal circumstances to entice the innocent party into marriage and had the innocent party known the truth, would not have entered into the marital contract (i.e. lying about wealth). Annulments are granted to the innocent party in all of these types of situations.
