Mediation Prior Trial

Spring Mediation AttorneysMost Courts will require mediation prior to the final trial setting.  The purpose of this mediation is to allow the parties one last opportunity to sit down and try to resolve their issues outside of the discretion of a judge or jury.  The format of this mediation is generally in a setting whereby both of the parties are separated and a mediator is appointed in an attempt to negotiate a settlement between the parties.  If a settlement cannot be reached, the case will go directly to trial without the need for any additional attempts at settlement or any more discovery.  If the case does resolve, the mediator and the attorneys for the parties will prepare a mediated settlement agreement which will be filed with the court.
