Assault

The technical definition of assault in Texas is conduct that causes another person to reasonably believe that they are in danger of immediate harm or unwanted bodily contact. Assault does not require physical contact, but does require an “immediate threat” of physical contact and actions that cause the alleged victim to believe that contact is forthcoming. Battery

Battery is basically an assault that “takes the next step,” in that battery occurs when the defendant has made unwanted physical contact with the victim with the intent to cause physical or emotional harm. An actual injury is not required to be charged with battery, as the intent of the defendant is what governs whether or not he or she is culpable for this crime. Aggravated battery is much like aggravated assault, in that the “simple” battery should generally be accompanied with the use of a weapon or “tool” that only adds to the punishment or harm that the defendant intends to inflict upon the victim.
