A Suit Affecting Parent-Child Relationship or a SAPCR is a legal action in which all the issues affecting a parent and child can be adjudicated in a single lawsuit, including custody, visitation rights, child support, adoption, paternity, and termination of the parent-child relationship. In divorces involving children, the SAPCR must be joined with divorce proceedings. With regards to parties that may file, typically it will be a parent, a child (through an authorized agent of the court), the child’s guardian or managing or possessory conservator, a governmental entity, or an authorized adoption agency.

In some instances, a grandparent may file a SAPCR in the process of seeking appointment as managing conservator of the grandchild. Additionally, under some circumstances, a SAPCR may be brought by a foster parent who has had actual possession and control of a the child for at least 12 months ending not more than 90 days before the petition is filed, and a person other than a foster parent who has had actual possession and control of the child for at least 6 months ending not more than 90 days before the petition is filed. If the child’s parents are deceased, a SAPCR may be brought by a relative of the child, such as grandparents, uncles, aunts, etc.
