prenuptial / marital agreements

Smith & Garg

Spring Texas PrenupsTypically, prenuptial or marital agreements are contracts that are often pondered when a party has a sizeable estate, or is financially well off, and has concerns about how his or her estate and assets would be divided in the event of a divorce.  Additionally prenuptial agreements (contracts drafted prior to entering into a marriage) and marital agreements (which can be entered into during the marriage) can also discuss what would become of the debts of either party, or who would be liable for certain and specific debts in the event of divorce.  Prenuptial or marital agreements cannot discuss anything regarding future child custody rights.  If, however, either party has children from a previous marriage and they want to ensure that their children get a portion of their estate, a prenuptial agreement may be helpful.

You may find it helpful to simply make a list of your most important concerns, and after discussing them together, you should consult with a Conroe, Spring prenuptial agreement attorney at Smith & Garg.
