Law BooksThe purpose of temporary restraining order (TRO) is to prevent a variety of harassing actions, such as telephone calls and any other type of communications intended to annoy or harass another person; threats of bodily injury; falsifying records; removing, tampering with, or damaging property, moving money around, etc.  There is a common misconception that a TRO is only sought when there is violence or physical abuse involved, which is not the case.  Often it is typical to file a TRO along with a divorce decree, to ensure that both parties' conduct is appropriate during the waiting period before a divorce becomes finalized.

After notice and hearing, the court may issue a temporary injunction, which can cover a multitude of different things such as: requiring the parties to complete a sworn inventory and appraisement revealing all property and debts of the parties; support being sought by either parties; production of certain records; ordering payment of attorneys’ fees; and awarding one spouse exclusive occupancy of the residence during pendency of the case.  These are just some examples.

Protective orders are typically sought when there have been incidents of family violence.  Protective orders will cover a range of restrictions such as: prohibiting a party from committing further family violence; directly or indirectly communicating with a member or members of the family; going near the home or work place of one of the parties; stalking; engaging in conduct that is harassing; and possessing a firearm.  Again, these are just some examples of what can be included.  The maximum duration of a protective order is two years.
