Spring Sexual Assault

Sexual assault is a crime in Texas that can come with many variations, but one unfortunate commonality is that all of the charges you're about to see briefly explained below carry heavy consequences. If you have been charged in the Houston area, including The Woodlands, Conroe, Humble, Kingwood, Tomball, Cypress, Huntsville or any other community in or around Houston, you need to contact the Spring sexual assault lawyers at Smith & Garg immediately for a consultation.

Below are a few examples of the charges we've defended clients against during our years of service as Spring sexual assault lawyers:

Sexual Abuse - Children and Adults

Sexual abuse is a term that modern statutes has used to encompass several more "traditional" charges, including rape, statutory rape and forced sex acts. Generally, sexual abuse of a child or an adult involves a defendant forcing a victim to perform a sex act or sex acts against his or her will, and the punishment for a conviction of sexual abuse is a felony in Texas.

Abuse of Impaired Victims

Abuse of impaired people, whether their impairment is mental or emotional in nature, is much the same as a sexual abuse charge above, except for the fact that the law basically adopts a factual norm in place of proof of consent. Basically, the law states that impaired individuals cannot legally consent to sexual activity, and any activity along those lines would be considered forced.

Indecent Assault and Battery

Indecent assault and battery is much like a typical charge of assault and battery, except that the word "indecent" means that there were circumstances surrounding the situation that exacerbated the problematic conduct. For instance, the defendant may have forced a kiss or a sexual act on a child or someone who could not defend him or herself, or it could constitute any other act that's considered especially lewd under the circumstances.

Overall, sexual assault charges of any kind in Texas are not to be taken lightly. They are almost always felonies, and if you currently face any of these charges, contact the Spring sexual assault lawyers at Smith & Garg immediately to schedule a consultation.
