Temporary Orders

temporary ordersTemporary Orders are orders or rules which control the parties prior to the final outcome of the divorce. These orders or rules can cover quite a bit of ground.  However, generally, the Court can may render orders including granting of temporary injunctions for the preservation of property and the protection of the parties until the divorce is final.  A Court may also issue orders such as:

  1. Orders requiring a sworn inventory and appraisement of the real and personal property owned or claimed by the parties and specifying the form, manner, and substance of the inventory and appraisal and list of debts and liabilities;
  2. Orders requiring payments to be made for the support of either spouse;
  3. Orders requiring the production of books, papers, documents, and tangible things by a party;
  4. Orders requiring payment of reasonable attorney's fees and expenses;
  5. Orders appointing a receiver for the preservation and protection of the property of the parties;
  6. Orders awarding one spouse exclusive use of the property or residence during the pendency of a divorce;
  7. Orders prohibiting the parties, or either party, from spending funds beyond the amount the Court determines to be reasonable and necessary for living expenses;
  8. Orders awarding one spouse exclusive control of a parties usual place of business or occupation.
